Newest update from Department of Immigration – Subclass 186,187 applications lodged prior to 1 July 2017

Prior to 1st July, applicants who are paid above 180,000 guaranteed annual earnings can be exempt from English testing or skills assessment under subclass 186/187 visas for the employer sponsored pathways.

The 1st July major changes initially removed both the above English and skills high income exemptions. This change not only impacted applications lodged after 1st July, but applied also to applications lodged prior to 1st July but not yet currently approved.

The Department of Immigration has received a high amount of pressure and complaints due to the above retrospective change, and have now announced that the high income exemption for skills and English will remain available to pending ENS and RSMS (186/187) applications who met the legal criteria at time of lodgement prior to 1 July 2017.

If you have any questions, please do not hesitate to contact STC lawyers via e-mail or phone.

Thank you.
